Programme Executive Summary (Scope):

The RBN Traditional Court is a body established in terms of and regulated by the Bophuthatswana Tradional Court Act.  it resolves cases arising out of and involving Bafokeng customs and traditions referred from the Bafokeng Makgotla.  The Traditional Court sit at most three times a week in adjudication, twice a month on in-loco inspections and once a month as an appeal seat for Magistrate Bafokeng.

In Scope:

  • To adjudicate cases amongst Bafokeng Community members arising out of Bafokeng customs and traditions
  • To sit at most three times a week in adjudication;  twice a month on in loco inspections; and once a month as an appeal seat for Magistrate Bafokeng;
  • To provide a panel of assessors for Magistrate from time to time as and when invited to do so by the Chief Magistrate Bafokeng on cases adjudicated by the Magistrate Bafokeng where Bafokeng customs and traditions have to be eascertained in a case or where they form part of the facts in a case before the Magistrate;
  • To impose fines up to R 200.00 or small or largelivestock  in fines;
  • To issue warrants of committal for failure to appear before the Traditional Court;
  • To manage case load:
    • File weekly reports of all cases (mediations and adjudications) with the HOD office;
    • File on a weekly basis a Court Roll of cases (mediations, adjudications and appeals) which ae postponed or scheduled to appear before the Traditional Court, fourteen calendar days ahead of their scheduling with the HOD;
    • Prepare and serve all Court Process ( Summonses, Warrants, Subpoenas) at least 7 days before the scheduled Court date;
    • Escalate all transport requests to the HOD at least fourty eight hours before they are due to be served taking into account that the summons should be served at least 7 days before the scheduled Court date.

Out- of Scope:

  • To adjudicate civil cases where amounts being claimed exceed R200.00;
  • To adjudicate cases where the Kgosi, Kgosana, Traditional Councillor, a Kgotla of the Bafokeng, the Royal Bafokeng Administration or any other RBN Entity or Department is a party to the case;
  • To commit parties found guilty to a proson term, banishment or lashing.
